RECENT RESULTS

Since 2008, Russell Hippe has represented hundreds of individuals and businesses in a broad range of civil trial matters, from all aspects of contested domestic cases, to federal RICO defense, to commercial litigation disputes, to intellectual property disputes, to professional malpractice, to bankruptcy. Some of Mr. Hippe's favorable results in trial matters, including significant trial wins over "Super Lawyers", are detailed below.

General Civil:
Mr. Hippe has secured excellent results for clients, representing both plaintiffs and defendants, in hearings, contested evidentiary hearings, and trials in general civil cases in both federal and Georgia courts. The below noted "wins" and "favorable results" are merely specific examples of Mr. Hippe's success and are not inclusive of all of the successful results he has obtained for his many clients. Trial Win - Jury Trial Verdict in June of 2010 in matter of Legacy Painting v. The Potts Company - Rockdale Superior Court. Mr. Hippe, representing the Plaintiff, obtained the highest possible jury verdict for his client – 139,408 in a 4 day jury trial. He defeated "Super Lawyer" George Reid.

Favorable result in multi day commercial trial spanning several months in 2011 and 2012 in matter of TR Piedmont v. Lenox Financial Mortgage - Fulton State Court. This case involving over a million dollars of prospective liability. Mr. Hippe, representing the Defendant Lenox Financial, secured a trial result over $500,000 less that the judgment amount the Plaintiff was seeking.

Dismissal of RICO defendant on April 24th 2012 in matter of NCI Group, Inc., et al v. Cannon Services, et. al – Northern District of Georgia. Mr. Hippe, representing the principal target individual defendant, secured his client's dismissal in a complex, multi year federal RICO case involving millions of dollars of prospective liability.

Appellate Win in November of 2013 in matter of Carol Perry, Juanita Sexton and Whitefield Academy, Inc. v. George Amah - Cobb Superior Court. This case involved a complex real estate and easement dispute. Representing the Defendant, Mr. Hippe was engaged after Dr. Amah, while represented by another attorney, lost summary judgement on multiple counts in the Superior Court. After Mr. Hippe filed a detailed brief with the Court of Appeals, the Plaintiffs Ms. Perry and Sexton agreed to vacate the order appealed. The Court of Appeals later vacated a critical portion of the order in favor of Whitefiled Academy, Inc.

Trial Win in complex federal securities litigation case filed in 2013 in matter of Christian Fletcher v. Staindl, Le and E*Trade - Northern District of Georgia. This case involved allegations of fraudulent investment and trading. Mr. Hippe, representing the Plaintiff, aggressively pursued discovery to get to the bottom of the fraud and obtained a $125,000 judgment against the Defendant Mr. Le and a favorable resolution of the case.

Favorable result in complex federal trademark infringement cases filed in 2013 in matter of Chanel, Inc. v. Sarah Janelle - Northern District of Georgia. Mr. Hippe, representing the Defendant Ms. Janelle, secured a successful result which allowed his client to avoid significant exposure.

"Defense Win" in jury trial in April of 2015 in matter of Carol Perry, Juanita Sexton and Whitefield Academy, Inc. v. George Amah - Cobb Superior Court. This case involved a complex real estate and easement dispute. Representing the Defendant, Mr. Hippe was engaged after Dr. Amah, while represented by another attorney, lost summary judgement on multiple counts. After improving his client's problematic situation by filing an appeal, and by prevailing at the Court of Appeals, Mr. Hippe secured a jury verdict well less than the verdict the Plaintiffs sought or ever offered in pre trial negotiations.

Divorce:
A significant portion of Mr. Hippe's practice is focused on the trial of contested domestic cases. His website exclusively dedicated to domestic law is located at www.attorneyrussellhippe.com. Mr. Hippe has secured many favorable results for clients in this area. For example, back in 2009, in one of his first domestic cases, Mr. Hippe secured the immediate release of a client from improper incarceration on a contempt sanction entered prior to Mr. Hippe's engagement. Mr. Hippe defeated a highly respected "Superlawyer" divorce firm during a subsequent contested hearing to keep his client out of jail. He then went on to achieve a successful result for his client in a 3 day trial in Cobb Superior Court.

Mr. Hippe has also secured favorable results for clients in pre trial settlements and mediations. He is presently involved in numerous divorce cases, both contested and non-contested, involving all aspects of domestic disputes. When dealing with domestic cases, Mr. Hippe counsels for pragmatic positions and fully advises of the advantages and cost savings of amicable resolutions. However, if a trial of a domestic case is required, Mr. Hippe has significant experience. Again, the below noted "wins" and "favorable results" are merely specific examples of Mr. Hippe's success and are not inclusive of all of the successful results he has obtained for his many clients in the area of domestic litigation.

Trial win in the multi day bench trial in January of 2010 in matter of In re T. 16 Suns - Cobb Juvenile Court. Mr. Hippe, representing the natural father, secured a custody award in favor of his client over the recommendation of DFCS.

Trial win in Thompson v. Thompson multi day bench trial in November of 2009 - Cobb Superior Court. Mr. Hippe, representing the Defendant Mr. Thompons, secured a favorable result in this trial which was principally over alimony and attorney fees. Ms. Thompson, represented by "Superlawyer" firm of Kessler, Schwartz and Solomiany, was seeking over 100k in attorney fees. The trial judge awarded less than 10k.

Favorable result in Mendez v. Davis multi day contested matter spanning 2010 and 2011 - Dekalb Superior Court. Representing the natural mother, Mr. Hippe brought a paternity matter against a professional athlete. After numerous hearings, Mr. Hippe secured a favorable support award and result for his client.

Trial win in Reece v. Lopez - Douglas Superior Court - 2012. Mr. Hippe, representing the biological father, dealt with a visitation contempt and custody modification action that spanned several months and involved numerous hearings. Mr. Hippe secured the contempt and modification award his client was requested, including an award of attorney fees.

Trial win in multi day bench trial in February of 2012 in Hoosh vs. Hoosh - Dekalb Superior Court. Mr. Hippe, representing the Plaintiff Mr. Hoosh, secured a custody and trial result dramatically better than Ms. Hoosh, represented by "Super Lawyer" Stephen Clifford, ever offered and went on after trial to defeat Mr. Clifford's Motion for New Trial.

Trial win in contested custody modification hearing in January of 2014 in Passlock v. Matriez - Cobb Superior Court. Mr. Hippe, representing the mother, secured the initial custody award of three minor children in this contested custody modification action. Mr. Hippe successfully kept this advantage and was able to secure a final custody award in favor of his client.

Outstanding result in Stephens v. Leavell, a 2014 custody modification action pending in Cobb County. Representing the biological father, Mr. Hippe brought a custody action on behalf of his client who had not seen his daughter in ten (10) years. He successfully obtained a temporary order of primary physical custody for his client, which has been a blessing to the child.

Bankruptcy: 
Mr. Hippe has had dealings with all ranges of consumer bankruptcy from simple individual Chapter 7 cases, to complex Chapter 7 cases, to Chapter 13 cases, to Chapter 11 reorganization.  Mr. Hippe has secured discharges for individual clients in numerous Chapter 7 cases, has successfully dealt with the U.S. Trustee’s office on challenges to debtor Chapter 7 qualifications, and has counseled numerous clients on alternatives to bankruptcy filings and the various chapters of relief available to individuals and businesses.  Mr. Hippe has been approved to represent corporate debtors in Chapter 11 cases.

Prior Real Estate Experience:
Mr. Hippe prior experience (1997-2007) was the owner of a highly successful residential real estate closing firm.  His firm was responsible for handling over 20,000 transactions totally over 2 billion dollars in gross loan value representing the top local and national lenders and Chicago Title.
